Tom DeLay's name has to stay on Texas Ballot

HA! A Federal Appeals court in New Orleans (darn those Republican-appointed activist judges! ) has denied the appeal by the Texas GOP to remove his name from the November ballot. So it stays, and the Dems get to go out and beat the corruption drums. AND have his face featured prominently in campaign adds I'm sure.

Note to self: when resigning from elected office in midst of corruption probe and moving to new state, do not leave spouse behind in residence in former congressional district. Some silly judge may use said spouse as proof that you STILL live in the congressional district!

I don't think that part matters one way or the other. These are the points that seem important to the courts:

(1) He won his party's primary. Texas law does not allow a political party to replace its candidate after the candidates have been named. The Democrats and the Libertarians have already named their candidates; therefore, the Republicans cannot now change their candidate.

(2) The U.S. Constitution says that he must be a resident of the state that elected him "on election day." It's not yet election day; therefore, he is not yet disqualified.

It will be interesting to see if the Supremes will take up his appeal. He may stand a better chance there IF they agree to consider it but I doubt that they will.

I think we should send the thank-you card to Jack Abramoff. And, while we're at it, we should thank him for this, too.

I wonder if that means we might see some indictments before the November elections?

Legally they can go around Alito and file with a different justice in an attempt to get it before the entire court but they have said that they won't be doing that. Pity! It would have given Clarence Thomas a chance to prove that he's more of a clown that Alito.
