Court Decides To Defend Constitution, Rules Against BushCo
In a stunning defeat for the Bush administration, the Supreme Court ruled in favor of preserving Habeas Corpus.
WASHINGTON -The Supreme Court ruled Thursday that foreign terrorism suspects held at Guantanamo Bay have rights under the Constitution to challenge their detention in U.S. civilian courts.Note how the corrupt corporate media (in this instance, the Associated Press) decided to spin this story: "The vote was 5-4, with the court's liberal justices in the majority."
The justices handed the Bush administration its third setback at the high court since 2004 over its treatment of prisoners who are being held indefinitely and without charges at the U.S. naval base in Cuba. The vote was 5-4, with the court's liberal justices in the majority.
Justice Anthony Kennedy, writing for the court, said, “The laws and Constitution are designed to survive, and remain in force, in extraordinary times.”They should have said that the four fascists on the court were overruled by the sensible majority. Seven of the nine justices are Republicans! Justice Kennedy is a conservative Republican with a slight Libertarian streak.
The Constitution of the United States of America survived an aborted attempt by the criminal Cheney-Bush administration to subvert it. The court is precariously balanced at the moment between the voices of reason and the forces of darkness. It is almost certain that at least two of the voices of reason on the court -- Ruth Bader Ginsburg and John Paul Stevens -- will retire within the next four years. (P.S. -- And just for the record, John Paul Stevens is a Republican!)
Vote for Obama to preserve the Constitution.
P.S. -- As a refresher for anyone who just dropped in from another planet: The Bush administration has decided that "enemy combatants" have no right to habeas corpus. They can be detained forever without ever seeing the evidence against them and without ever being allowed a lawyer to defend them or even given a day in court to hear the charges against them. Furthermore, the Bush administration has decided that the president, as commander-in-chief, has the authority to declare anyone, including even U.S. citizens, an enemy combatant. Once the president finds that someone is an "enemy combatant," he loses all rights, including the right of habeas corpus. And it doesn't matter if he is a U.S. citizen or not.
According to the Bush administration, anyone who aids terrorism is an enemy combatant. Your grandmother might be an enemy combatant if she gave money to a charity and that charity in turn provided assistance to orphans in the Middle East through a charity there that also receives support from any of the organizations on our official terrorist list.
